Notary Services in Cape Town
A Notary can act as a Commissioner of Oaths and can authenticate and certify Affidavits which are signed in their presence. Documents can also be certified as true copies by them; e.g. university degrees and educational certificates.
The authentication process involves confirming the Identity of the person signing the document. The Notary is required to seal the document with their official embossed Seal or rubber stamp with “Notary” and the Notary’s name on it.

Authenticating Documents for Use Abroad
If the document being authenticated by the Notary is required to be used outside of South Africa, the authentication process is more complex. Once the Notary has authenticated the client’s signature; the Notary’s signature is then verified by the Registrar of the High Court, the Department of International Relations and Cooperation (DIRCO) or other government offices.
The procedure has been simplified by The Hague Convention of 5 October 1961. If the country in which the document is to be used is part of the Hague Convention, only the High Court needs to authenticate the Notary’s signature by attaching an Apostille to the document.
What Documents Should a Notary Public Certify in Cape Town?
Certain work is strictly reserved for Notaries. The Deeds Registries Act requires certain documents to be certified and signed before a Notary:
- Marriage-related:
- Antenuptial Contracts (see cost of drafting an ANC if you are thinking of getting married);
- Postnuptial Contracts;
- Life Partnerships - Legal recognition of life partnerships, including cohabitation agreements, contracts of permanent relationship or civil unions;
- Personal Servitudes eg. Usufructs (for further information on legal services related to property, check out our Usufruct Property Services);
- Pradial Servitudes eg. Right of way;
- Authenticating general Powers of Attorney - Granting another person the authority to act on your behalf in legal or financial matters and specific POAs; e.g. POA for overseas property purchases.
- Notarial Bonds;
- Long term Leases, Cessions and Subleases;
- Notarial Long-term Leases - Used when signing leases for periods of more than 10 years or rental contracts, often required by property registries.
- Notarial Cessions - The formal transfer of rights, typically related to property or contractual rights;
- Cession of Exclusive use Areas in terms of the Sectional Titles Act;
- Hague Apostilles - Authentication for documents intended for use abroad, in line with international agreements such as the Hague Convention.

Authenticate Documents for International Use
There are 2 ways to authenticate documents for use in another country (other than South Africa). Before starting, establish whether both countries are signatories to the Hague Convention (South Africa is). This will dictate which process you need to follow. Regardless of the route, a notary public is usually the first port of call.

Apostille (the quick way):
- Requirement: Both the originating country (e.g., South Africa - SA) and the destination country must be signatories to the Hague Convention on the Legalisation of Foreign Public Documents (commonly known as the Apostille Convention).
- Process: A designated authority (often a government department or court) in the originating country issues an Apostille certificate, which is attached to the original document. This single certificate authenticates the document for use in any other Hague Convention member country.
- Benefit: Simpler and faster than the long route.
- Limitation: Only applicable if both countries are signatories to the Hague Convention.
- Authentication (the long expensive way):
- Requirement: Used when the destination country is NOT a signatory to the Hague Convention.
- Process: A multi-step process involving several authorities:
- Notary Public:
- Action: The notary public authenticates the original document and/or a copy of the document by witnessing the signature, certifying the copy, or otherwise verifying its authenticity.
- Note: Can be expensive, but it's usually the quickest step.
- High Court:
- Action: The High Court confirms the notary public's authority and capacity to authenticate documents.
- Note: Can take a few days. The High Court itself usually does not charge a fee, but the notary may charge for facilitating this step.
- Department of International Relations and Cooperation (DIRCO in South Africa):
- Action: DIRCO adds its own certificate, confirming the authority of the High Court registrar.
- Note: Requires an appointment to be scheduled and takes time. There may or may not be a fee.
- Embassy/Consulate of the Destination Country:
- Action: The embassy/consulate of the destination country legalises the document, ultimately confirming its validity for use in that country.
- Note: This is often the most expensive step, as embassies typically charge per page.
- Notary Public:
- Benefit: Allows documents to be used in countries that are not part of the Hague Convention.

Documents where a Notary has an interest
If the notary has an interest in a notarial document, this will render it invalid. In a 1961 case involving Van den Heever v Khan and another, a notary was a partner of the creditor, an attorney, and had attested a notarial bond which the South African court ruled was invalid.
So, interestingly enough, notaries cannot stamp their own signatures, and need to find an independent notary public to assist them.

- A Notary Public is an attorney (i.e. somebody with an LLB degree who has served articles, passed their admission exams, and been admitted as an attorney of the High Court) who has passed a higher level exam, proven their competence, and taken an oath to be admitted by the High Court as a Notary Public; the oath involves a promise to faithfully execute the duties of a Notary Public.
- Who can notarise documents in South Africa?
- The short answer is that only a Notary Public can notarise documents in SA.
- The longer answer is that it depends on what you mean by the word "notarise"; a Commissioner of Oaths can provide a basic level of certification of a document and if that is what you seek you can obtain that service from a notary (all notaries are Commissioners of Oaths) as well as Commissioners of Oaths from other professions such as chartered accountants and police officers. However, if you want a Notary's signature and official seal on a document; only a Notary Public will be able to provide that service.
